The WebAIM Guide to Web Accessibility - Terms of Use

Terms of Use

The WebAIM Web Accessibility Training is provided subject to these terms of use. You must read this End User License and Services Agreement and indicate your agreement to its terms prior to installing or using the Training Content. By installing or accessing the Training Content, you acknowledge that you have read all of the terms and conditions of this agreement, understand them, and agree to be bound by them. All rights, title, and interest not expressly granted are reserved. These terms of use are subject to change.

For each license purchased, WebAIM grants to you one (1) non-exclusive, non-transferable license to:

  1. use the Training Content on one (1) computer at a time;
  2. make one (1) copy (in machine-readable form) of the Training Content for back-up purposes only; and
  3. use the Training Content for personal, informational, and non-commercial purposes only.

The Training Content is licensed, not sold. All rights, title and interest not expressly granted under this Agreement are reserved. If you do not agree with and do not wish to be bound by these terms of use, you may return the Training CD-ROM within 30 days of purchase for a full refund.

System Requirements:

  • An XHTML compliant Web browser (Internet Explorer 5.0+, Netscape 6+, Firefox, Opera 5+, Safari, etc.). Although the Web pages will gracefully degrade and will still be useable in older browsers, the layout and page formatting may not display as intended.
  • 4X or faster CD-ROM drive.
  • Windows Media Player 9+ OR RealOne Player OR Quicktime 6+ to view multimedia content. The players may be downloaded by clicking the media player icons within any training page that contains video or audio. Other players (Flash, Shockwave, etc.) may be required for specific content sections - download links are provided within the content.
  • Internet access:
    • Because of restrictions within Media Players that may block local access to multimedia, Internet access may be required to view certain multimedia elements.

Licensees of the Training Content shall not:

  • cause or permit the disclosure, copying, renting, licensing, sublicensing, leasing, disseminating, or otherwise distributing of the Training Content by any means or in any form, without the prior written consent of WebAIM;
  • redistribute in any form or part to non-licenced third parties (this prohibits you from, among other things, providing a copy or original of the software to any other non-licenced person);
  • network the Training CD-ROM or its contents or otherwise use it or its contents on more than one computer or computer terminal at the same time per license, unless permission is granted under a Network Distribution Agreement (see below);
  • allow the Training Content to reside concurrently on more than one computer per license granted;
  • translate, reverse engineer, decompile, disassemble, modify or create derivative works based on the Training Content;
  • present, display, or provide the Training Content in large group, training, or presentational settings, except as granted under the Presentation License Terms (see below)

Licensees of the Training Content may:

  • make a one-time, permanent transfer of ownership of the Training Content to another individual. The receiving party shall be subject to these terms of use;
  • transfer a license and installation of the Training Content from one computer to another, so long as both computers are owned and administered by the individual or organization to whom the license is granted. The Training Content may be installed on one computer per license at a time, however, it may be uninstalled and transfered to a new computer under this agreement;

Holders of Training Content Presentation Licenses may:

  • present or display the Training Content in large group, training, or presentational settings, provided the content is subject to all other terms of this agreement.

Holders of Multiple Training Content Licenses may:

  • duplicate the source CD-ROM as necessary for distribution to individual users and licensees. For instance, if you purchase 20 user licenses, WebAIM will provide limited number of CD-ROMs, which may be duplicated and distributed to fulfill those 20 user licenses as described within this license.
  • NOT provide network, intranet, internet, or multi-user access to the Training Content to fulfill the number of purchased licensed, UNLESS a Network Distribution Agreement is provided by WebAIM. Network distribution is allowed, but only under restricted terms of use. The Network Distribution Agreement will be provided to you upon request (contact us). WebAIM understands that network access is often the easiest method for multi-user access. Modification of template, styles, and other Training Content features may also be granted in writing upon request. WebAIM is happy to grant you network distribution rights, provided that a Network Distribution Agreement is entered into and multi-user access to the content is:
    • not public (i.e., Internet accessible to anyone other than those for whom licenses have been granted);
    • not searchable by any publicly accessible search engine or indexing tool;
    • password protected or otherwise restricted to the organization(s) and licensees to whom the licenses have been granted;
    • accessible either concurrently or over time by only licensed individuals numbering in total no more than the number of licenses granted.

Terms of Use Frequently Asked Questions

May I install the Training Content on more than one computer?
No. You may install the Training Content on one computer per license. You may transfer the Training Content to another computer as long as the content is first removed from the original computer and both computers are under your control and/or ownership
May I make a copy of my Training CD or installation?
Yes, but for backup purposes only. The copy may not be distributed. WebAIM will provide replacements for damaged/lost CD-ROMs for a minimal shipping fee.
May I give away or sell my Training CD to someone else?
Your license and use of the Training CD may be transfered to another party as long as you give up all ownership and rights. The person receiving the Training CD shall be subject to these terms of use. Under these terms you may not sell your Training CD or license.
May I display part of the Training Content in presentations, class instruction, group demonstrations, or training.
No, unless you have purchased a presentation license for that content. The presentation license allows small or large group presentation of the Training Content.
May I use part of the Training Content on my Web site/print handout
Small text portions (quotes, references, information), generally under 500 words, may be used under our copyright terms as stated above AND if attribution is given to WebAIM as the original author. Larger portions of the training (including graphics, multimedia, non-text elements, or textual elements over 500 words) may not be distributed either electronically or in print form unless written permission is granted. The WebAIM Web site contains many Web accessibility resources which may be distributed in both electronic and print form under its terms of use (see the bottom of the site page). Presentation license holders may use electronic or print information within their presentations as long as copyright information remains intact.
May I print out portions of the Training Content for personal use?
Yes. The printed content shall be under the same conditions of this agreement. Because the content is intended to be viewed within a Web browser, the quality of printed materials cannot be guaranteed.
My organization purchased many licenses, may we allow access to the Training Content on our network/intranet/private Website?
Not unless a Network Distribution Agreement has been signed and provided by WebAIM. Network distribution is subject to restricted terms of use. If you're interested in multi-user distribution of the Training Content, please contact us.
May I add our logo to the Training Content/CD-ROM?
Modification of the content is not allowed under these terms of use. In certain circumstances, permission to 'brand' or otherwise modify the content will be granted by WebAIM.
There's a problem/spelling error/technical inaccuracy/grammar mistake/oversight in the Training Content, who can I inform?
We're always striving to make our training content better. If you have any comments or recommendations, send them our way.
I have a question that is not answered here, where can I get help?
We're happy to answer any questions you may have or provide changes/amendments to these terms of use in specific circumstances. Please let us know if we can help you in any way.
